Purpose
To provide guidance on obtaining photos and videos of students, employees, and guests for use in college marketing.
Definition
Implied Consent: The assumption that a person has given permission for an action, which is inferred from his or her actions, rather than expressly or explicitly provided.
Policy Statement
Kansas City Kansas Community College (KCKCC) properties are public places, and therefore each student, employee, and visitor (“person”) gives implied consent to KCKCC and its agents to use such person’s name and images from photographs and videos, taken while on KCKCC property, in college advertising and promotional materials, including but not limited to print, radio, television, internet advertising, and digital, without compensation or further consent.
KCKCC reserves the right to take, and use for marketing purposes, photographs and video of college facilities and scenes, events, students, employees, and visitors for college use in any locations where subjects do not have an expectation of privacy. These photos and videos are often obtained in classrooms, hallways, study areas, residence halls, and athletic events.
The college does not attempt to collect photo release forms from students, employees, or visitors except when the photo subject is under 18, featured as a testimony in a video or print instance, or photos are taken in an area of the institution where privacy may be expected. Release forms are not required for educational record photos.
Employees and/or students have the ability to opt out of college photography by completing the Opt Out of Consent for Photography form. This form can be obtained from the Marketing and Institutional Image office. At events or in public spaces, employees and/or students should alert photographers that they have filed a form not to be photographed.
Permission
Students and instructors will be asked to participate when taking photos or videos in a classroom, lab, or similar small environments. Students and instructors may decline participation and will not be photographed or videotaped.
Minors (under the age of 18) will not be asked to participate without the permission of a parent or guardian.
