DACA, the DREAM Act, and DREAMers
DACA
Deferred Action for Childhood Arrivals (DACA) is a 2012 Executive Order that provides eligibility for a work permit and a 2-year deferment from any deportation actions. The Employment Authorization Document (EAD card) received by approved DACA applicants grants the card holder permission to work in the United States. However, the EAD card does not grant the holder any other benefits such as resident or immigrant status in the U.S.
The DREAM Act
Development, Relief and Education for Alien Minors Act (the DREAM Act), first introduced in 2001, is legislation that would have provided eligibility for conditional residency, but thus far it has failed to pass through Congress and is not law.
DREAMers
DREAMers has become a commonly used term to refer to individuals that qualify for DACA. The widespread use of this term often misleads individuals into mistakenly believing that their DACA work permit grants them residency in the U.S.
Under the 2004 Kansas State House Bill 2145 (HB2145), students may be eligible for in-state tuition at KCKCC.
Undocumented or DACA students may qualify for in-state tuition under HB2145 if they attended high school in Kansas for three (3) or more years, graduated from high school in Kansas or earned their GED in Kansas and filed a HB2145 Affidavit with KCKCC.
* Undocumented or DACA students who do not qualify for in-state tuition under HB2145 are billed for out-of-state tuition.

- Application requirements cannot be waived.
